VOXTiX – Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by VOXTiX ("Company", "we", "us", or "our"), including our website, cloud voice platform, mobile applications, and AI communications tools (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our Services.

2. Description of Services

VOXTiX provides proprietary cloud-based communications solutions, including Hosted Voice, UCaaS, Contact Center services, and AI-driven automation tools. Services are provided on a subscription basis as defined in your specific Service Agreement or Quote.

3. Use of Services & Restrictions

You agree to use the Services only for lawful purposes and in accordance with these Terms. You are prohibited from:

• Using the Services for any fraudulent, harassing, or illegal activity.
• Transmitting any "spam," "chain letters," or unsolicited mass messaging.
• Attempting to circumvent, disable, or interfere with security-related features of the platform.
• Engaging in any automated use of the system, such as using scripts to send messages or harvest data.

4. Billing and Payment

Services are billed monthly in advance unless otherwise specified in your Service Agreement. All fees are non-refundable. VOXTiX reserves the right to suspend or terminate services for non-payment exceeding thirty (30) days from the invoice date.

Taxes, regulatory fees, and universal service fund contributions will be added to your invoice where applicable.

5. Fair Use Policy

Our "unlimited" calling and messaging plans are subject to our Fair Use Policy. These plans are intended for normal, reasonable business use. VOXTiX reserves the right to review usage for signs of automated dialing, continuous call forwarding, or other patterns indicative of non-human or excessive usage, and may transition such accounts to metered billing with notice.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOXTiX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

7. Termination

You may terminate your Services in accordance with the terms of your specific Service Agreement. VOXTiX may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Missouri, United States, without regard to its conflict of law provisions.
